特殊教育法制在台湾的建构与检讨

摘 要:就目前特殊教育产生的问题而言,应回归到教育的目的去检讨,从教育基本权的保障作为出发点,探讨如何建构一个特殊教育制度,达到促进身心障碍学生自我实现的目的。因此,本文一开始先介绍特教育法的目的和相关规范,并描述修法前后的背景。接下来探讨教育基本权下应建构一个促进身心障碍学生自我实现的特殊教育制度。最后从教育基本权的观点切入检讨新修正的特殊教育法,身心障碍学生从鉴定、安置到申请入学可能面临的问题,并提出一些未来可能的修法方向。

Construction and Review of Legal System of

Special Education in Taiwan

Abstract: For the problems happened in special education area, we should revise them based on purpose of education. We should begin with the protection of fundamental right of education and explore how to construct a well-designed system of special education. Therefore, this article introduces the purpose of Special Education Act and regulations which are related to the act at first. Second, this article examines the background when the Act is revised. Third, this article tries to construct a system of special education that can help students with disability achieve self-actualization. Finally, this article examines the amendments of the Act from aspects of fundamental right of education and provide some suggestions for further revision.
