高校学生内部申诉制度的重构方向与完善路径——以新《普通高等学校学生管理规定》为视角

  要:由于受特别权力关系理论及行政诉讼受案范围的影响,只有部分类型的高校与学生纠纷案件可以进入司法审查程序,因此,学生权利救济的保障程度不高。学生申诉是一种非诉讼类的行政救济机制。其效率高、成本低,有利于保障学术自由和大学自治,有利于体现协商民主,有利于高校主动纠错与自我监督。文章选取七所高校的内部规定进行调查,认为我国高校校内申诉制度存在着申诉委员会行政色彩浓厚、地位不中立,评议程序不健全等问题。完善校内申诉制度,应遵循以学生为本、申诉不加罚、正当程序、重证据、重协商的原则,应完善申诉机构的设置与构成;明确回避制度;规范申诉委员会的权限及相关程序性规定。

The Reconstruction Direction and Perfection Path of the Appeal System for Students at Universities

— Based on the textual analysis of seven universities’ Provisions on the Administration of University Students

Abstract: Because of the influence of the Theory of Special Power Relation and the scope of accepting administrative cases, only some types of the disputes between universities and students can enter into judicial review procedure. Therefore, the degree of the guarantee of students’ right to relief remains low. The appeal system for Chinese undergraduates is one of the non-litigation relieving systems to settle disputes in education. The appeal system for undergraduates has such advantages as high efficiency and low cost. It is in favor of academic freedom and the university autonomy; it gives expression to consultative democracy system. It is propitious for a university to carry out error recovery and self-supervision. In this paper, seven colleges are chosen as evaluation index. It is found that many problems happen among these universities’ appeal systems: the student board of appeal has a big tendency toward administration; the position of the student board of appeal is not neutral; the review procedure is considerable ambiguity. In order to perfect the appeal system for undergraduates, we should follow some principles, for example, student-oriented principle, non-adding penalty principle, due procedure principle, and emphasizing negotiation and evidence. We should also take measures to improve the student board of appeal, to ensure the property, proportion and term of office, to construct challenge system, to standardize authority of the board, to better the produce of informative system and to perfect hearing system and refine review process.
