Combining Learning with Thinking in Legal Education and Its Practice

 Abstract In order to improve students’ critical thinking and their ability of practicing, college education, especially the legal education should follow the ideas of learning from practice and combine thinking with learning, so as to simulate student’s interest in learning and carry out the objectives of education. To achieve the practicality and professionality of legal education, it is important to explore an teaching mode that mix knowledge, ability and quality in one by combing thinking and learning, in addition to encourage students to take part in law practice and to take courses such as case teaching, legal clinic, moot court and so on. The teaching practice with postgraduates shows that teachers should not only make students learn the knowledge but also shape their legal thinking and improve their ability of analyzing and solving the problem, through elicitation, exploration, discussion and participation and by combining learning with thinking.
