What Is Jurisprudence?

 Abstract: Jurisprudence should be distinguished from legal philosophy, which is a branch of philosophy relevant to law. Jurisprudence in the sense of “Allgemeine Rechtslehre”, “Rechtstheorie” or “general jurisprudence” is oppositely a “surplus subject” of jurisprudence as knowledge and technology of law. In consideration of its attribution, jurisprudence can’t undertake two missions that exclude each other: being a foundation course of law while playing the part of general theory of law, even the “two-step mode” of instruction adopted.
